## Socket Mobile Developer Portal — License Agreement

_Version V2 · Effective October 1, 2026_

This License Agreement governs your access to and use of the Socket Mobile, Inc. ("Socket Mobile") Developer Portal, the Socket Mobile CaptureSDK and related documentation, sample code, and tools (collectively, the "Materials"). By creating an account you confirm that you have read, understood, and agree to be bound by these terms.

### 1. License Grant

Subject to your compliance with this agreement, Socket Mobile grants you a personal, non-exclusive, non-transferable, revocable license to access the Developer Portal and use the Materials solely to develop, test, and distribute applications that integrate with Socket Mobile data capture devices.

### 2. Restrictions

You agree not to:

- Reverse engineer, decompile, or disassemble the Materials except as permitted by law.
- Remove or alter any proprietary notices, labels, or trademarks.
- Use the Materials to build a product or service that competes with Socket Mobile's offerings.
- Sublicense, rent, lease, or otherwise transfer the Materials to a third party.
- Use the Materials in any application intended for use in high-risk activities including but not limited to medical life-support, aviation, or nuclear facilities.

### 3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You must promptly notify Socket Mobile of any unauthorized access. You agree to provide accurate information during registration and to keep your profile up to date.

### 4. SDK Updates

To ensure the best possible end-user experience with Socket Mobile devices, you agree to update your application to incorporate the then-current version of the CaptureSDK with each new release or build of your application. Using an outdated version of the CaptureSDK may result in reduced compatibility, missing features, or unresolved issues with Socket Mobile data capture devices. Socket Mobile may, at its discretion, require a minimum supported CaptureSDK version as a condition of continued AppKey issuance or Developer Portal access.

### 5. Analytics

The CaptureSDK may collect limited technical information about the environment in which it runs, such as device type, operating system version, host application version, and CaptureSDK version. Socket Mobile uses this information to maintain compatibility, improve its products, and provide support. Please refer to our [Privacy Policy](https://www.socketmobile.com/terms-conditions/privacy-policy) for more details.

### 6. Application Submissions

If you submit an application through the Developer Portal for review (including for MFi certification or app key issuance), you grant Socket Mobile a worldwide, non-exclusive, royalty-free license to access, review, test, and reference your submitted information for the purposes of evaluating compatibility and providing support. Socket Mobile is not obligated to approve any submission.

### 7. Intellectual Property

All right, title, and interest in and to the Materials, including all intellectual property rights, are and will remain the property of Socket Mobile and its licensors. No rights are granted to you other than as expressly set forth herein. The Socket Mobile name, logo, and all related marks are trademarks of Socket Mobile and may not be used without prior written consent.

### 8. Privacy

Socket Mobile processes personal information you provide in accordance with our [Privacy Policy](https://www.socketmobile.com/terms-conditions/privacy-policy). By creating an account you acknowledge the Privacy Policy and consent to the processing described therein.

### 9. Confidentiality & Beta Materials

Some Materials may be designated as pre-release or beta. You agree to keep such Materials confidential, to use them only for evaluation, and to provide feedback at Socket Mobile's request. Socket Mobile may discontinue or modify any beta Materials at any time without notice.

### 10. Warranty Disclaimer

The Materials are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Socket Mobile does not warrant that the Materials will be uninterrupted, error-free, or free of harmful components.

### 11. Limitation of Liability

To the maximum extent permitted by applicable law, Socket Mobile and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with this agreement or your use of the Materials, even if advised of the possibility of such damages. Socket Mobile's total liability for any claim under this agreement is limited to the greater of (a) the amount you paid Socket Mobile in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).

### 12. Termination

Socket Mobile may suspend or terminate your access to the Developer Portal at any time and for any reason, including violation of this agreement. Upon termination you must cease use of the Materials and destroy any copies in your possession. Sections 6, 9, 10, and this section will survive termination.

### 13. Export Compliance

You agree to comply with all applicable export laws and regulations, including those of the United States, and not to export, re-export, or transfer the Materials to any country, entity, or individual subject to applicable sanctions or embargoes.
